Independent contractor

Meaning in contract & commercial law, with examples

nounCommon term

In contract & commercial law, independent contractor means: A person or business that provides services to a client under a contract for services, without being the client's employee.

How it is used

Contractors decide how they do the work, send invoices and usually pay their own taxes and insurance. Courts look at the reality, not the label: if the relationship works like employment, the person may be treated as an employee. Also called a freelancer or consultant.
